Trux Solutions – Clearinghouse Checks Now a Part of CSVA Inspections

Next time you pull over for a roadside CSVA inspection, you can expect a Clearinghouse check to be part of the process. During this check, inspectors will ensure that CDL and CLP drivers do not have any current drug or alcohol violations that would restrict them from operating a commercial vehicle.

The DOT Clearinghouse program came into effect on January 6th of this year to make it possible for employers and inspectors to know if a driver has had a drug or alcohol violation. If they have, they will be restricted from driving a commercial vehicle until they have completed the proper return to work process.

Until now, inspectors had no way to reliably check whether a driver had a violation. But thanks to the DOT Clearinghouse registration that has changed, and these checks will now be a regular part of roadside inspections.

If it is discovered during a roadside inspection that a driver has an unresolved infraction, they will be immediately pulled from any safety-sensitive duties. Their cargo will be stranded until a relief driver can arrive to pick it up.

Understanding Clearinghouse Violations

WThe DOT Clearinghouse database was set up to help both employers and law enforcement officers to quickly identify whether a driver has a drug and alcohol violation. When a driver has a violation, they are prohibited from driving until they have completed the appropriate return to work process.

Prior to January 6th, it was possible that a driver with prohibited status could go on driving a commercial vehicle without the employer’s knowledge. Now that the Clearinghouse has come into full effect however, it has effectively bridged the safety gap.

Maintaining a safe fleet

Running regular Clearinghouse queries is an essential part of knowing that your drivers are operating safely and legally. These queries are considered a consumer report, and as such they are protected by the Privacy Act and the Fair Credit Reporting Act which means you will need the drivers’ permission to run them.
